In accordance with Article 347.2 of the Public Sector Contracts Act 9/2017 of 8 November, that transposes into Spanish law the Directives of the European Parliament and Council 2014/23/EU and 2014/24/EU, of 26 February 2014, the Profile of the Contractor of the Tarragona Port Authority is integrated into the Public Sector Contracting Platform, where the information is published on all the calls for tenders issued by the Entity, as well as their results.
The Tarragona Port Authority, hereinafter the TPA, applies the general principles of contracting set out in the current valid legislation, given its nature as a Public Corporate under the Ministry of Development. The objective of the TPA’s policy is to optimise the relationship between cost, quality and provision in the contracting of all kinds of goods and services, guaranteeing in all cases the principles of advertising, concurrence, transparency, equality and non-discrimination.
1. Legal conditions applicable to the contracts of the Tarragona Port Authority
With the coming into force of the Public Sector Contracts Act 9/2017, of 8 November, and in application of the provisions of its Article 3, the TPA is considered as a Non-Public Administration Adjudicating Power. It is also an Entity that operates under the provisions of Act 31/2007, of 30 October, regarding contracting procedures in the water, energy, transport and postal services sectors.
Based on the above, in compliance with Additional Disposition 8, Points 2 and 3, of Act 9/2017 and in general, the adjudication of contracts by the TPA that are for the purposes enumerated in the area of application dealt with by the current legislation on contracting procedures in the water, energy, transport and postal services sectors, will be governed by said legislation (Act 31/2007).
Those contracts excluded from the application of the current legislation on contracting procedures in the water, energy, transport and postal services sectors, that are signed for the water, energy, transport and postal services sectors by the TPA will be governed by the pertinent dispositions of the aforementioned Act 9/2017 (Articles 318 to 320).
